These HPE software-as-a-service (“SaaS”) Terms govern HPE’s provision of SaaS offerings to the Customer, as further detailed herein.
- The transaction for and delivery of any HPE SaaS offering is governed by the following terms in descending order of precedence:
- a. HPE Hybrid & Private Cloud Solution-Specific Commercial Terms
- b. HPE aaS Commercial Terms
- c. The service description for the solution
- d. HPE aaS Terms for Customer
- Invoices will be issued by, and payments must be made to AWS as HPE’s invoicing and payment agent.
- These terms do not apply for resale or distribution, they are only applicable for direct sale to customers.
